  1. The Promoters of this “Preference Centre Campaign” (“Contest”) are:

Hereafter jointly referred to as “Promoters”.
  1. By participating in this Contest, the participants (“Participants”) accept these Terms and Conditions which includes the Promoters’ Terms of Use and acknowledge the Privacy Policy applicable to the jurisdiction where the participants reside (“Residing Jurisdiction”) (See Appendix I to this Terms and Conditions). Any violation of these Terms and Conditions may result in disqualification. In the case of conflict between these Terms and Conditions and any other materials arising from or in connection with this Contest, these Terms and Conditions shall prevail.
  1. This Contest is open to any Participant who resides in the same jurisdiction as any one of the Promoters, who have reached the legal age at the Participant’s Residing Jurisdiction, and who are not current or former employees or ambassadors of the Promoter or its affiliated companies, their advertising and promotional agencies or Sweat Collective members.
  1. This Contest commences at 12:00AM Hong Kong time (“HKT”) on 9 September 2024 and ends at 11:59PM HKT of 31 August 2025 (“Contest Period”). Entry (“Entry”) that is submitted after the 11:59PM HKT of 31 August 2025 would be considered as invalid.
How to Enter
  1. To enter, each Participant must follow the instructions and complete all mandatory fields of a form about shopping preferences including a piece of creative writing on the topic: “Tell us about a product/event/service you would like to see from lululemon in the future.” - (Max. 300 words) (“Form”), and submit the completed Form within the Contest Period.
    An Entry is considered “received” and recorded by the Promoters when it has been submitted by the Participant. Promotor will verify all Entries submitted by Participants.
  1. Entries must be submitted in accordance with the instructions and the language specified in the Form.
  1. Promotor reserves the right to modify the Form at any time and from time to time, without prior notice.
  1. Each Participant may submit and/or update the Form more than once. However, each Participant will earn a maximum of one (1) Entry only into the Contest throughout the Contest Period based on the first submission date of the completed Form.
  1. By entering the Contest, Participants agree that all information collected through the Form will be used for market research to provide more personalized services to guests.
  1. The Promoters reserve the right to (a) verify the validity of Entries and the Participants; and (b) disqualify any Participant whose Entry is not in accordance with these Terms and Conditions, or who otherwise committed misconduct or fraud. The Promoters’ decision is final, and no communication will be made for such decision or related process.
  1. All contents of the Entries (“Content”) submitted by the Participants shall not contain or embed any URL link that:
    • is pornographic, sexually explicit, obscene or indecent;
    • portrays or promotes violence, dangerous stunts or illegal activities;
    • contains private, sensitive or confidential information of the Participant or others;
    • contains unlawful, harmful, threatening, derogatory, defamatory, libellous, tortuous, misleading, offensive or any otherwise objectionable content;
    • portrays or promotes discrimination based on race, sex, religion, nationality, disability, ethnicity or sexual orientation;
    • promotes bigotry, racism, hatred or harm against any group or individual;
    • fail to comply with applicable third-party terms;
    • contains anything that exploits children or minors or that depicts cruelty to animals;
    • contains any copyrighted, trade-secret, proprietary, patented proprietary or trademarked materials without the express permission from the owner of such rights; post any person’s name, likeness, voice or biographical information without the express permission from such person (or if that person is a minor, from that person’s parent or legal guardian); or
    • is generated through robotic or programmed attempt exploiting all possible combinations. If Content submitted by the Participants is found to include any such elements or are otherwise illegal, inappropriate and/or offensive, they will be automatically disqualified.
Prize & Determination
  1. During each month of the Contest Period, there shall be only one (1) winner (“Winners”) selected from the Entries received from all Residing Jurisdictions during that month. Entries submitted and considered for the preceding months’ prize winning will not be reconsidered for prize winning in the remaining Contest Period.
  1. Prize:
    Each Winner will be awarded any two (2) lululemon items of their choice (including markdown items and "We Made Too Much" products) from the available stock at their preferred lululemon store (see Clause 14 below) at maximum total retail value of HKD1,500/ MOP1,500/ MYR800/ SGD350 (inclusive of Goods and Services Tax)/ THB8,000 (inclusive of Value Added Tax)/ TWD7,000 (inclusive of Value Added Tax) depending on the Winner’s Residing Jurisdiction. Winners may not top up to purchase items with total retail value exceeding the said amount.
  1. Winners will be contacted through email for arrangement of Prize redemption no later than the 10th of the month following their Entry submission, or on the next business day if that day is not a business day. Winners that have responded to the Promotor as instructed shall receive a confirmation email with Prize redemption details (“Confirmation Email”) no later than the 21st of the same month. Winners will need to collect the Prize from their preferred lululemon store in their Residing Jurisdiction as indicated in the Confirmation Email within one month of their receipt of the Confirmation Email. Winners will be asked to provide their identification document (matching their full name provided earlier) for verification purposes when they collect the Prize from the indicated lululemon store. Redemption of Prize in other lululemon stores or outside of the Winners’ Residing Jurisdiction is not permitted. Prizes not redeemed within one month will be deemed unclaimed and forfeited.
  1. This Contest is a game of skill. Chance plays no part in determining the Winners. Entries received during each month of the Contest Period will be individually judged by a judging panel of the Promoters by no later than the 10th of the following month based upon the followings:
    • Completeness on the Participant’s submission (e.g. following the Entry instructions) - 10 points;
    • Originality & uniqueness - 10 points; and
    • Relevancy - 10 Points.
  1. All Entries must be an independent and genuine creation by the Participants. Entries must not have been published previously and/or have been used to win prizes in any other contests whether with the Promoters or otherwise.
  1. If the Promoters cannot reach or receive any response from the Winners after two (2) attempts, the Promoters reserve the right to select substitute Winner(s) as a result. The Promoters shall not be held liable for any unsuccessful attempts to notify the Winners.
  1. The Prize will be awarded “as-is”, and is, if applicable, subject to its terms of use. All Prizes are non-returnable, non-refundable, non-exchangeable, non-transferable and cannot be exchanged or redeemed for cash or other items.
  1. Any and all applicable taxes on the Prizes are solely the Winners’ own responsibility, unless the Promoters are required by a competent government authority in a Winner’s Residing Jurisdiction to be responsible for any tax. In such case, the applicable tax will be covered by the respective Promoter, and necessary information including personal identification numbers and other personal information will be collected from the relevant Winner for the purpose of tax reporting only. The Promoters reserve the right to select substitute Winner if the relevant Winner fails to provide the necessary information to comply with tax reporting requirements.
General
  1. Participants shall be responsible for the Entry and the Content which they submit. The Promoters shall not be liable in any way for such Entry to the extent permitted by law.
  1. All intellectual property rights in the Entries become the properties of the Promoters. Participants further consent to the Promoters using and sub-licensing the Participant’s name and Entry in any media perpetually without remuneration for the purposes of delivering and promoting this Contest and marketing. Participants further consent to the Promoters disclosing the Participant’s personal information and Entry collected to any government authority (if required by law).
  1. If, for any reason, this Contest cannot proceed as a result of tampering, unauthorized and improper interfering, fraud, technical difficulties or other causes beyond the reasonable control of the Promoters which corrupt or affect the administration security, fairness, integrity or proper conduct of this Contest, to the extent permitted by law the Promoters reserve the right: (a) to disqualify any Participant who improperly interferes with the Entry process; (b) to take any action that may be available; and/or (c) to cancel, terminate, modify or suspend this Contest.
  1. To the extent permitted by law, the Promoters make no warranties, representations or guarantees, express or implied, in fact or in law, as regards to this Contest.
  1. The Promoters as well as their associated agencies and companies shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect, consequential or special loss) or for personal injury which is suffered or sustained, in connection with or arising from this Contest. Examples include but not limited to (a) any Entry or Prize that is incorrect, invalid, misdirected, disqualified, cancelled, late, delayed, lost, altered, damaged or otherwise interrupted (whether before or after their receipt by the Promoters); (b) any technical issues (whether or not under the Promoters’ control), unauthorised access or improper interference; (c) Winner’s tax liability arising from or in connection with this Contest; or (d) use of a Prize by the Winner, except if such liability cannot be excluded by laws.
  1. Without limiting any other terms herein and to the extent permitted by law, the Participant indemnifies the Promoters for any breach of the above terms, conditions or warranties.
  1. The Promoters’ failure to enforce any of their rights at any stage does not constitute a waiver of the same.
  1. Any costs associated with submitting the Entry is the Participant’s sole responsibility and is dependent on the Internet service provider used.
  1. This Contest and these Terms and Conditions shall be governed by the laws of the following jurisdictions:

  1. By submitting Content to the Promoters, Participants grant the Promoters a royalty-free, perpetual, irrevocable, non-exclusive worldwide license to use, copy, edit, adapt, publish, translate, create adaptions from, make available, communicate and distribute the Contents in whole or part and to incorporate it in other works in any form, media, or technology now known or later developed. By submitting the Content, the Participants warrant that they have the right to grant the abovesaid license. The Participants also grant the Promoters the right to sublicense the Content to any person or entity of the Promoters’ choice.
    To the maximum extent permitted by law, the Participants agree not to assert their moral rights (e.g. the right to be identified as authority or to object to derogatory treatment in the Content. The Promoters reserve the right to (a) use or not use all or part of the Content in promoting the Promoters’ products and services (e.g. the Promoters may use the Content in their advertising and public relations); and (b) edit Content, in whole or in part, including, but not limited to, changing the wording, sentence structure and order and omitting or paraphrasing the original wording. Where the Promoters use the Content, the Participants consent that the Promoters may (but shall not be required to) attribute the Content to the Participants as the author.
  1. If the Participants have any questions regarding this Contest, the Promoters may be contacted by email at gec@lululemon.com.hk.
  1. If any of the provisions of these Terms and Conditions are held to be invalid or unenforceable in whole or in part, that part shall be severed from the remainder of the provisions and the validity of the other provisions and the remainder of the provision in question shall not be affected.
  1. The Promoters reserve the right to interpret these Terms and Conditions at their sole and absolute discretion, whose decision is final and conclusive.
  1. In the event of any discrepancy between the English and the Chinese versions of these Terms and Conditions, the English version shall prevail.

  1. 凡報名參加是次比賽,即代表參賽者(「參賽者」)接受本條款和細則(其內容包括主辦單位之使用條款),且認可參賽者所在的司法管轄區(「居留司法管轄區」)的隱私政策(請參見條款及細則的附錄I)。任何違反本條款及細則之行為可能導致取消參加資格。本條款及細則若與本比賽所產生或與本比賽相關的任何其他資料發生衝突,以本條款及細則為準。 
  1. 參賽者須居住在任何一個主辦單位的所在管轄區內、達到其居留司法管轄區的法定年齡或以上,且並非主辦單位或其聯屬公司的現任或前任員工、品牌大使、其廣告及推廣之代理或Sweat Collective 成員。 
  1. 比賽日期由香港時間2024年9月9日午夜12時正開始至2025年8月31日晚上11時59分結束(「比賽期間」)。任何於香港時間2025年8月31日晚上11時59分後提交的參賽資料(「參賽資料」)將被視為無效。 
如何參賽 
  1. 參賽資格:每一名參賽者須按照指示填妥一份有關購物喜好的表格的所有必填欄位,包括一篇創意文章,分享「告訴我們您將來希望從 lululemon 看到的產品/活動/服務。」-最多300字(「表格」),及在比賽期間提交填妥的表格。 
    參賽者提交參賽資料後,主辦單位將視為「已收到」並記錄該參賽資料。主辦單位將驗證所有參賽者提交的參賽資料。 
  1. 參賽者必須按照表格上所列的規則和語言提交參賽資料。 
  1. 主辦單位保留隨時修改表格的權利,恕不另行通知。 
  1. 每位參賽者可以多次提交和/或更新表格。然而,在整個比賽期間,每位參賽者最多可在首次提交填妥的表格時獲得一次參賽資格。 
  1. 參加本活動即表示參賽者同意透過表格收集的所有資訊將用於市場研究,以便為客人提供更個人化的服務。 
  1. 主辦單位保留權利 (a) 驗證提交資料的有效性及參加者身分;(b) 對任何所提交的參賽資料不符合本條款與條件的參賽者,或有其他不當或詐欺行為的參賽者,將取消其參加資格。主辦單位所做出之決定為最終決定,且不會就該決定或相關過程作另行通知。 
  1. 參賽者提交的參賽資料的內容及連結(「提交內容」)並不可以包含: 
    • 色情、淫褻或不雅內容; 
    • 展示或鼓吹暴力、危險動作或違法活動; 
    • 參賽者或其他人的私人、敏感或機密資料; 
    • 非法、有害、威脅性、貶損性、誹謗性、中傷性、侵權性、誤導性、攻擊性或任何其他令人反感的內容; 
    • 展示或鼓吹種族、性別、宗教、國藉、殘疾、族裔或性向歧視; 
    • 對任何人或群體表達偏激、種族主義、仇恨或傷害; 
    • 未能遵守適用的第三方條款。 
    • 任何傷害兒童或未成年人或描述虐待動物的內容; 
    • 未經版權、商業秘密、專有權、專利權或商標權所有者的明確許可,包含任何受版權、商業秘密、專有權、專利權或商標權保護的資料;未經任何人(如果此人是未成年人,則應征得其父母或法定監護人)的明確許可,張貼此人的姓名、肖像、聲音或傳記信息;及 
    • 通過機器或程序嘗試利用所有可能的組合而生成的。 
      如任何參賽者的提交內容被發現包含任何以上元素或在其他方面是非法的、不適當及和/或令人反感的,他們將被自動取消資格。 
獎品與評分 
  1. 在比賽期間的每個月,主辦單位只會從當月所有居留司法管轄區收到的參賽資料中選出一名得獎者(「得獎者」)。在較早月份提交並已獲考慮獲獎的參賽資料將不會在剩餘比賽期間被重新考慮獲獎。 
  1. 獎品:
    每位得獎者將可從其選定的 lululemon 專門店的現有庫存中選擇任何兩件lululemon 商品(包括降價商品和「We Made Too Much」產品),最高可獲的總零售價值為HKD1,500 / MOP1,500/ MYR800/ SGD350(包含商品及服務稅)/ THB8,000(包含增值稅)/ TWD7,000(包含加值營業稅),視乎得獎者的居留司法管轄區。  得獎者不得加額購買超過上述零售總額的商品。 
  1. 主辦單位將在得獎者提交參賽資料後的次月10 日(如果該日不是工作日,則下一個工作日)或之前透過電子郵件聯繫得獎者,以安排獎品兌換事宜。已依指示回覆主辦單位的得獎者將在同月 21 日或之前收到確認獎品兌換資訊的電子郵件(「確認電郵」)。得獎者須於收到確認電郵後的一個月內,按照確認電郵中的指示,從其居留司法管轄區選定的 lululemon 專門店領取獎品。  得獎者在指定的 lululemon 專門店領取獎品時,將需提供身份證明文件(與先前提供的全名相符)以進行驗證。得獎者將不被允許在其他 lululemon 專門店或其居留司法管轄區以外的lululemon專門店兌換獎品。一個月內仍未兌換的獎品將被視為無人認領並被沒收。 
  1. 本次比賽的取勝單純在於技巧運用,並不涉及「機會」元素。在比賽期間每個月所收到的參賽資料,將由主辦單位的評審團在次月 10 日或之前進行單獨評核,評核標準如下: 
    • 提交的完整度(例如:有否按照參賽準則)- 10分 
    • 原創性和獨特性 - 10分;以及 
    • 相關性 - 10分 
  1. 所有參賽資料必須由參賽者獨立創作且內容真實 。參賽資料不得在先前公開發表,和/或於任何其他比賽中贏取獎品,無論該活動是否由主辦單位主辦。 
  1. 如主辦單位經兩次嘗試後仍無法聯絡得獎者或取得得獎者的任何回覆,主辦單位則保留挑選另一名候補得獎者的權利。 對於任何未能成功通知得獎者,主辦單位將不承擔任何責任。 
  1. 獎品均按「原樣」的基礎提供及其使用受條款及細則約束。所有獎品均不可退回、不可退款、不可交換、不可轉讓,且不能交換或兌換現金或其他物品。 
  1. 獎品的任何和所有適用稅款由得獎者自行負擔,除非得獎者居留司法管轄區的主管政府機構要求主辦單位負責得獎者的任何稅款。  在這種情況下,適用稅款將由相應的主辦單位承擔,並且將從相關得獎者收集必要的資訊(包括個人身分號碼和其他個人信息),僅用於稅務報告的目的。如果相關得獎者未能提供必要的資訊以遵守稅務報告要求,主辦單位保留挑選另一名候補得獎者的權利。 
一般條款 
  1. 參賽者應負責其提交參賽資料及提交內容。在法律允許的範圍內對於提交內容的任何責任,概與主辦單位無關。 
  1. 所有提交內容之知識財產權將歸屬於主辦單位。參賽者進一步同意,主辦單位基於進行與推廣本比賽以及行銷目的,得在任何媒體上永久使用和再授權參賽者姓名和提交內容,且無須支付報酬。參賽者進一步同意,(若受到法律要求)主辦單位將向任何政府機關揭露蒐集之參賽者個人資訊及提交內容。 
  1. 如果,基於任何理由,包括不當篡改、未經授權和干涉行為、詐欺、技術困難或其他超出主辦單位合理控制範圍之原因而破壞或影響系統安全性、公平性、誠信及本比賽的正常運作,導致本活動無法進行,在法律允許範圍內,主辦單位將保留下列權利:(a) 對提交資料過程上有不當干涉行為的參賽者取消其資格;(b) 採取任何可能的行動;和/或 (c) 取消、終止、修正或暫停本比賽。 
  1. 在法律允許範圍內,主辦單位皆不對本比賽作任何明示或默示、事實上或法律上的保證、聲明或擔保。 
  1. 與本比賽有關的任何損失或損害(包括但不限於間接、附帶或特殊損失),或因本活動而遭受或持續的人身傷害,主辦單位及其代理和聯屬公司概不負責。除依法不得排除該責任外,此包括但不限於以下情形:(a) 任何提交資料或奬品有不正確、無效、有誤導、無資格、被取消、遲到、拖延、遺失、遭竄改、受損或受到其他干涉(無論是主辦單位接收之前或之後發生);(b) 任何技術問題(無論是否在主辦單位控制下)、未授權的存取或不當干涉;(c) 得獎者就本活動的報稅義務;或 (d) 得獎者對奬品的使用。 
  1. 不限制此處任何其他條款規定的情況下及在法律所允許範圍內,參賽者如有任何違反上述條款、條件或保證,需賠償主辦單位相應損失。 
  1. 若主辦單位在任何階段未行使其任何權利,並不代表放棄該權利。 
  1. 與提交參賽資料相關的任何費用均由參賽者自行承擔,並取決於所使用的互聯網服務提供商。 
  1. 本比賽以及條款及細則應受以下司法管轄區的法律管轄:

  1. 透過向主辦單位提交內容,參賽者授予主辦單位免版稅、永久、不可撤銷、非排他性的全球許可,以使用、複製、編輯、改編、發布、翻譯、創作改編、提供、與此交流及分發整個提交內容或其部分,並以現在已知或以後開發的任何形式、媒體或技術將其合併到其他作品中。 透過提交內容,參賽者保證參賽者有權授予上述許可。 參賽者還授予主辦單位權利,將提交內容再許可給主辦單位選擇的任何個人或實體。 
    在法律允許的最大範圍內,參賽者同意不主張參賽者的精神權利(例如被認定為授權者或反對在提交內容中進行貶損處理的權利。主辦單位保留 (a) 在推廣其產品和服務時使用或不使用全部或部分提交內容的權利(例如,主辦單位可能會在其廣告和公共關係中使用提交內容);以及 (b) 編輯全部或部分提交內容,包括但不限於更改措辭、句子結構和順序以及省略或解釋原文。在主辦單位使用提交內容時,參賽者同意主辦單位可以(但不是必須)將參賽者列為提交內容作者。 
  1. 如對本比賽有任何問題,參賽者可透過電子郵件gec@lululemon.com.hk聯絡主辦單位。 
  1. 如果本條款及細則的任何規定被認定為全部或部分無效或無法執行,則該部分應與其餘規定分開,且其他規定的有效性和相關規定的其餘部分應持續有效。 
  1. 主辦單位保留以自身唯一和絕對酌情權解釋本條款及細則的權利,其決定是最終且具有決定性的。 
  1. 如果本條款及細則的英文版本與中文版本存在任何差異,則以英文版本為準。
